Nothing in these Terms excludes or limits liability to the extent that applicable law prohibits such exclusion or limitation.
9. Indemnification
To the extent permitted by law, you will be responsible for claims, losses, damages, liabilities, and reasonable expenses arising from your unlawful use of the Network or any violation of these Terms, except to the extent caused by Operator’s own negligence, willful misconduct, or other conduct for which responsibility cannot legally be shifted to you. Operator reserves the right to take exclusive control and defense of any such claim otherwise subject to indemnification by you, in which event you agree to fully cooperate with Operator in asserting any available defenses.

These Terms do not create any agency, partnership, or joint venture between you and Operator.
13. Dispute Resolution
Any dispute, claim or controversy in connection with, arising out of or relating to these Terms or the enforcement, interpretation or validity of these Terms (a “Dispute”), will be determined by arbitration in Houston, Texas before a single arbitrator at a time and location designated by the arbitrator, but not exceeding 90 days after a demand for arbitration has been made. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Rules of Commercial Arbitration (the “Rules”). If the parties cannot agree on a single arbitrator within five business days of any party invoking arbitration, the arbitrator will be selected in accordance with the Rules. Judgment on the award shall be final and may be entered in any court having jurisdiction. This provision will not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. YOU AGREE THAT ANY DISPUTE YOU BRING THAT ARISES FROM OR RELATES TO THE NETWORK MUST BE INITIATED WITHIN ONE YEAR FROM THE RELEVANT DATE OF YOUR ACCESS TO THE NETWORK, AND THAT NO DISPUTE MAY BE BROUGHT AFTER THAT TIME.
The parties shall share equally in all costs assessed by the arbitrator for administration as well as the arbitrator’s fees and expenses from the initiation of the arbitration through a final award, subject to the arbitrator’s authority to allocate the same upon a final award in accordance with the law controlling the dispute at issue. The prevailing party shall have the right to recover its costs, including both taxable costs and expenses, reasonable and necessary attorneys’ fees, and arbitration fees and expenses. In any arbitration arising out of or related to these Terms, the arbitrator may not award any incidental, indirect, or consequential damages, including damages for lost profits or any punitive or exemplary damages.
The parties agree to arbitrate solely on an individual basis, and that these Terms do not permit a class arbitration or any claims brought as a plaintiff or class member in any class or representative arbitration proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
